These Terms of Service (Terms) govern your access to and use of the Site. By using the Site, you agree to these Terms and to our Privacy Policy and Cookie Policy.

1. Who we are

JOCES is a civil engineering consultancy based in New South Wales, specialising in road, stormwater, flooding and development engineering services for local government and private developers.

2. Using the Site
  • You must use the Site lawfully and not infringe the rights of others or interfere with the Site’s security, integrity or availability.

  • We may update, suspend or discontinue any part of the Site at any time without notice.

  • Content on the Site is provided for general information only. It is not professional or engineering advice. You should obtain independent advice before relying on any information.

3. Accounts (if applicable)

If you create an account or portal login:

  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

  • You must notify us promptly of any unauthorised use or security breach.

4. Intellectual property

Unless otherwise stated, all content on the Site (including text, graphics, logos, diagrams, downloads and layout) is owned by or licensed to JOCES and is protected by Australian and international intellectual property laws.
You may view the Site for your personal or internal business purposes. You must not reproduce, adapt, distribute, display, publish or create derivative works from any Site content without our prior written consent, except as permitted by law.

5. Third‑party content and links

The Site may contain links to third‑party websites or resources. We are not responsible for their content, accuracy, practices or availability. Use of third‑party sites is at your own risk and subject to their terms and policies.

6. Submissions you provide

If you send us enquiries, files, feedback or other content via the Site ("Submissions"), you warrant that you have the right to do so and that your Submissions are accurate, lawful and do not infringe any rights. You grant us a non‑exclusive, worldwide, royalty‑free licence to use, reproduce and communicate your Submissions for the purpose of responding to you, providing services to you, operating the Site and complying with law.
We will handle any personal information in Submissions in line with our Privacy Policy.

7. No warranties

To the maximum extent permitted by law, the Site is provided on an "as is" and "as available" basis. We make no warranties or representations about the Site or its content, including as to accuracy, completeness, timeliness, reliability, suitability or availability.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the Australian Consumer Law (ACL) that cannot be excluded, restricted or modified. If the ACL applies, our liability to you for failure to comply with a consumer guarantee is limited to (at our option) resupplying the services or paying the cost of having the services supplied again.

9. Liability

To the maximum extent permitted by law, we exclude all liability for any loss, damage, costs or expenses (including consequential, indirect, special or punitive loss) arising out of or in connection with your use of, or inability to use, the Site. Where liability cannot be excluded, it is limited to AUD $100.

10. Indemnity

You indemnify us, our officers, employees and contractors against all loss, damage, claims and expenses arising from your breach of these Terms or misuse of the Site.

11. Security

We implement reasonable technical and organisational measures to protect the Site; however, we cannot guarantee that the Site will be free from viruses, vulnerabilities or interruptions. You are responsible for implementing your own safeguards (e.g. backups, anti‑virus software).

12. Privacy and cookies

Our Privacy Policy and Cookie Policy explain how we handle personal information and cookies/online identifiers. By using the Site, you agree to those policies.

13. Changes to these Terms

We may update these Terms from time to time by posting the new version on the Site. Changes take effect upon posting. Your continued use of the Site constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
